What is a Mass Tort?
Several years ago, Congress passed a law to allow the consolidation of lawsuits against one Defendant before one Judge.
The idea was to avoid conflicting rulings and to encourage resolution of cases in one forum. This is called Multi District Litigation(MDL).
In the area of product liability, particularly drugs and medical devices, this has become known as Mass Torts.
It has worked with some success, but experience has shown cases take much longer to resolve when consolidated into a MDL.
There have been calls for reform, but for now, if you have been the victim of a recalled drug or medical device, your case will likely end up in a MDL.
Law firms frequently partner up for MDL's. Many "National" law firms solicit with TV advertising for clients throughout the US.
Our advice is to contact a local lawyer who will retain local control of your case. Your local law firm will then retain counsel or enter an appearance in the Federal Court where your case was assigned. While it may take time to get your case resolved, you will have the comfort of knowing your lawyer and having one on one access to you lawyer about your case and your other legal needs.
